Yes! Anyone is really able to get married in Argentina, regardless of his or her sexual orientation or nationality. Argentine law actually prioritizes foreigners by allowing them to set their wedding date as shortly as five days in advance.
Argentina became the first Latin American country to pass Marriage Equality in July of 2010. Previous to that civil unions between couples of the same sex had been legal in Buenos Aires since 2002.
If this is the first time you’ll be getting married -- that is, you’ve been single your whole life -- the only document you’ll to get married in Argentina is a valid passport. If you have been married before, please continue reading below, where we'll explain exactly what documents you'll need.
If you’ve been divorced or widowed and are planning to marry in Argentina you’ll also need your birth certificate, marriage certificate, and if applicable, your divorce decree. Each of these documents needs to be apostilled before you come to Argentina, and the process of obtaining the apostille will vary depending on your country of origin. In case you’ve never heard of it, an apostille is a seal which confirms the authenticity of the document it is attached to, and permits it to be used for legal purposes in other countries (i.e. so that you can get married!). Once your documents have been apostilled you’ll send them to us here in Argentina, where we will undertake and coordinate all the necessary administrative work to present for your wedding ceremony.
This does present a challenge but we will walk you through the process of exactly what you’ll need to do if this is your case.
If you and your partner have never been married before, we recommend you arrive in Buenos Aires on a Sunday. This allows us to start all of the paperwork on Monday, and ensures you will be able to get married by Friday!
While it is in general a requirement to get a blood test for syphilis before getting married, the Argentine's legislation has now made it entirely optional, another reason for which weddings are so friendly in Argentina. If you do choose to do the test, you must do it together in Buenos Aires and it will take up an extra morning of your time.
If you do not have a strong command of the Spanish language you will indeed need a translator! During the marriage ceremony you will be interviewed by the judge, who will usually want to know how you met your partner, or what love or fidelity means to you personally. If you can’t explain this in Spanish, or are doubtful of your ability, we will provide you with a translator at no additional cost. This person will translate simultaneously during the ceremony, ensuring that you’re aware of everything that’s going on.
Once your marriage certificate is issued by the judge, we will take it to the relevant Ministries to be legalized (apostilled). The apostille certifies that you marriage certificate is indeed an authentic document, and permits it to be used in all countries that are signatories of the Apostille Convention (if you’re not sure if your country is a signatory, you can check here: Apostille Convention. If you need two legalized certificates (and we do recommend getting two), we can provide you with the additional certificate. Getting the second certificate takes approximately 48 hours, and we can FedEx it to you if necessary.
